Lodging or Accommodation Contract
#name-guest: Hereinafter referred to as THE GUEST
#company-name: Hereinafter referred to as THE OPERATOR
This information is necessary for government agencies as required by Colombian laws, such as Migración Colombia and the Mincti Accommodation Registration Card, and for building access authorization.
By completing all the information, you are authorizing the Processing of Personal Data, which will be managed with the utmost care.
By signing the following contract, the parties agree to the following:
1. OBJECT.
Under this contract, the commercial company #company-name, identified with NIT 901.774.139-4, and hereinafter referred to as THE OPERATOR, will provide accommodation services to THE GUEST in one of the real estate units managed by #company-name, hereinafter referred to as THE ESTABLISHMENT.
THE OPERATOR may make changes to the real estate unit if THE GUEST agrees, as long as the accommodation is of the same or better conditions, or in case of force majeure or unforeseen events. Check-in time is from #check-in_time on the arrival day, and check-out time is until #check-out_time on the departure day.
Early check-in or late check-out will be subject to availability, and THE GUEST must pay the corresponding fee. The accommodation price will be charged in full regardless of the length of stay at THE ESTABLISHMENT. The provision of services covered by the contract and additional services offered by THE OPERATOR are subject to availability and the schedules, shifts, or physical availability of supplies, goods, facilities, or spaces for such purposes.
The Parties acknowledge that it is their intention for this Contract to always be legally regarded as an Accommodation or Lodging Contract and that it shall never be transformed into a lease agreement.
2. OBLIGATIONS OF THE OPERATOR.
THE OPERATOR's obligations are as follows:
2.1. Fulfill the service established in the object of this contract.
2.2. Attend, receive, process, and respond to requests, suggestions, complaints, or claims made by THE GUEST, which will be addressed according to the provisions regulating the right to petition.
2.3. Ensure the quality, health, and safety of the real estate unit.
3. OBLIGATIONS OF THE GUEST.
THE GUEST's obligations are as follows:
3.1. Identify themselves for registration at THE ESTABLISHMENT with the appropriate identification document, such as a citizenship card if Colombian, or a passport or relevant document if a foreigner. Under no circumstances are minors allowed to enter or stay at THE ESTABLISHMENT.
3.2. Pay the accommodation fee as agreed, on time, including any additional services and applicable taxes.
3.3. Maintain proper conduct that does not harm the life, dignity, or integrity of other guests and/or neighbors of THE ESTABLISHMENT. This duty of conduct extends to the property within THE ESTABLISHMENT and its common areas. In case of any damage and/or harm to THE ESTABLISHMENT's property and/or third parties, THE GUEST shall be solely responsible for repairing such damage and/or harm.
3.4. Register at the reception of THE ESTABLISHMENT all individuals included in the reservation, provided THE OPERATOR consents to it. No other individuals are allowed entry aside from those registered at the time of reservation. If this obligation is not met, THE OPERATOR may terminate the contract immediately without any refund.
3.5. Strictly comply with THE ESTABLISHMENT's rules and policies, including Check-In and Check-Out times, entry policies, respecting the maximum occupancy per unit, and adhering to basic building coexistence norms.
3.5.1. It is prohibited to use the real estate unit for purposes contrary to morality, good customs, or for purposes prohibited by law or authorities, such as the use of illicit substances, narcotics, or hallucinogens (even for medicinal use), sexual exploitation, etc. The entry of escorts is prohibited. These are serious violations that will result in contract termination and the eviction of THE GUEST.
3.6. THE GUEST may not transfer their contractual position in any way to third parties.
3.7. THE GUEST acknowledges that engaging in sports, physical activities, or any activity considered risky is done at their own risk and responsibility, releasing THE OPERATOR and its staff from any liability.
3.8. Properly use and maintain the furniture, equipment, and accessories available at THE ESTABLISHMENT. THE GUEST must return the real estate unit in the same condition as received and is responsible for any damages caused by their actions.
3.9. Allow THE OPERATOR's employees to access the unit for routine tasks, maintenance, and/or cleaning.
3.10. Allow THE OPERATOR reasonable inspection rights over the unit, including the right to enter or inspect the unit if deemed necessary by THE OPERATOR.
3.11. Pay fines imposed by authorities for violations of coexistence rules or the Police Code. THE GUEST is solely responsible for such fines.
3.12. Refrain from performing any work or repairs on the unit. If THE GUEST notices any deterioration or damage, they must immediately notify THE OPERATOR, who will address the issue as soon as possible.
3.13. The contract cannot be transferred without the express written authorization of THE OPERATOR.
3.14. Minors under eighteen (18) years old are strictly prohibited from entering THE ESTABLISHMENT for sexual tourism or exploitation purposes. According to Article 17 of Law 679 of 2001, THE OPERATOR warns THE GUEST that sexual exploitation and abuse of minors are criminally and administratively punishable under Colombian law.
3.15. Damages: THE GUEST commits to leaving the accommodation in good condition and is responsible for any missing or broken items, including the actions of other guests in their reservation. THE GUEST will cover the cost of repairs or replacements.
4. ACCEPTANCE OF LEGAL AND SPECIAL CONTRACTUAL CONDITIONS.
THE OPERATOR informs THE GUEST of the LEGAL PROHIBITIONS detailed below, which THE GUEST IRREVOCABLY AGREES TO COMPLY WITH.
LAW 679 OF 2001 (AUGUST 3): To prevent and counter sexual exploitation, pornography, and sexual tourism involving minors.
LAW 1329 OF 2009 (JULY 17): To combat commercial sexual exploitation of children and adolescents.
5. TERMINATION OF THE CONTRACT.
The contract may be terminated for the following reasons:
5.1. Expiration of the agreed term.
5.2. Mutual agreement between the parties.
5.3. Early termination due to THE GUEST's breach of any obligations stipulated in this contract.
6. EFFECTS OF TERMINATION.
6.1. Upon termination, THE OPERATOR may freely dispose of the apartment.
6.2. THE OPERATOR may inventory and remove THE GUEST's belongings from the unit for safekeeping at the GUEST's expense and risk.
6.3. If THE GUEST fails to pay, THE OPERATOR may sell the belongings to cover outstanding debts, with any surplus made available to THE GUEST.
7. PURPOSE AND USE OF THE UNIT.
The unit is rented exclusively for lodging, prohibiting any other use.
8. SEVERABILITY CLAUSE.
If any clause of this contract is declared invalid, the remaining clauses and the contract's fulfillment remain unaffected.
9. EXECUTIVE MERIT.
THE GUEST acknowledges that this contract, as well as any payment receipts, constitute enforceable documents for THE OPERATOR to demand payment without judicial or extrajudicial notices.
10. CONTRACTUAL AND NON-CONTRACTUAL CIVIL LIABILITY DECLARATION – USER COMMITMENT LETTER.
THE OPERATOR is not responsible for personal belongings, luggage, or other possessions left by THE GUEST in the premises of THE ESTABLISHMENT, during arrivals or departures, which must be under their strict care and supervision.
10.1. Release of Liability and Indemnification:
Personal belongings of any value should never be left unattended. THE OPERATOR disclaims all responsibility for the loss or theft of jewelry, money, documents, or other valuables of any kind. Every time they leave the accommodation, THE GUEST must close windows, lock all doors, and keep their personal belongings safe and secure.
Neither THE OPERATOR, the property owner, nor any of their representatives shall be liable for any injury, loss, illness, or damage to THE GUEST or THE GUEST's accommodation, nor for any alteration or inconvenience THE GUEST may suffer while occupying the property caused by the actions of neighbors or by unforeseen circumstances, including but not limited to interruptions in water, gas, electricity, or internet services.
11. AUTHORIZATION FOR CREDIT CHECK AND REPORTING TO CREDIT BUREAUS – HABEAS DATA – LAW 1266 OF 2008.
THE GUEST authorizes THE OPERATOR or whoever represents its rights or may in the future become a creditor to:
a) Check, at any time, with DATACRÉDITO EXPERIAN or any other database managed by an operator, all relevant information to assess their performance as a debtor and their payment capacity.
b) Report to DATACRÉDITO EXPERIAN or any other database managed by a data operator, whether processed or unprocessed, regarding the fulfillment or non-fulfillment of their obligations with THE OPERATOR.
This authorization does not prevent THE GUEST or their representative from exercising the right to verify at any time with DATACRÉDITO EXPERIAN or any other credit information bureau to which data has been provided, that the information is truthful, complete, accurate, up-to-date, verifiable, and in case it is not, to record their disagreement, demand rectification, and be informed of the corrections made.
This ensures THE OPERATOR's compliance with current regulations, especially Law 1266 of 2008 and other regulations that govern or amend it.
12. PERSONAL DATA PROTECTION – LAW 1581 OF 2012.
By signing this contract, THE GUEST authorizes Renty House S.A.S. to collect, use, share, delete, process, exchange, handle, update, and manage the data provided and incorporated into the various databases, in accordance with Article 10 of Decree 1377 of 2013.
THE GUEST may refuse this authorization by expressly stating so in a direct, clear, and written manner within thirty (30) days from the signing of this contract, to the email address provided for this purpose: rentyhousesas@gmail.com.
Additionally, THE GUEST is informed that the building is equipped with security cameras located in common areas such as the main entrance, hallways, and, if available, in amenities like the pool, gym, lounges, and parking areas.
These videos will be stored solely for security purposes.
Furthermore, as the data owner and in accordance with applicable legislation, THE GUEST may exercise their rights at any time, including:
Accessing the information,
Requesting its update, rectification, and/or suspension,
Revoking consent given for the processing of personal data by contacting the email address: rentyhousesas@gmail.com.
ELECTRONIC SIGNATURE CLAUSE
"This document is signed electronically in accordance with Law 527 of 1999 and Decree 2364 of 2012, which regulates electronic signatures."
